Access and User Account Issues

Content Issues, User Liability, and Liability

Intellectual, Industrial Property Issues and Special Issues of Commercial Law
Prohibition of use of trademarks: The user is not entitled to use any of the trademarks, service marks, logos, domain names and other identity marks of Truberries™ corporate identity.
Software License: Truberries™ grants the user a personal, worldwide, royalty-free, non-transferable and non-exclusive license to use the software provided for the sole purpose of facilitating the user to use the Services and participate in the market research.
Prohibited copy of source code: The user is forbidden to copy, modify, create a derivative work of the source code, reverse engineer, decompile it or otherwise attempt to extract the source code of the Software.
The user is not allowed to assign (or sublicense) the use of the Software license that has been granted to him / her.
The user retains copyrights, proprietary rights, and any other rights he already has on the Content that he submits, sends or displays through the site, application, platform, or participation in any Truberries™ market research. By submitting, uploading or displaying the content, the user provides Truberries™ a continuous, irrevocable, worldwide, royalty-free and non-exclusive license to reproduce, adapt, modify, translate, publish, execute or display any Content that the user submits, sends or projects. This license is granted for the sole purpose of facilitating Truberries™ to perform, promote, distribute and promote its Services.
The user declares and warrants to Truberries™ that he has all the necessary rights and powers to grant the above license.
Delete/User Exclusion
Please use the site, app, platform, or participate in any Truberries™ market research in a way that does not offend third parties or other members of the users? community. For example, you may not use a username that may be considered offensive or inappropriate by other users or by the community in general. You may not use a username containing content that involves violence, pornography or hate or other content that may be considered inappropriate. We retain the right to judge whether the behavior of a participant is inappropriate. We retain our right to completely delete a user's account without notice and further explanation. Personal Data Protection Policy
Truberries™ commits to a high level of protection of its users' personal data in accordance with the requirements of Greek Law Nr. 2472/1997 and the relevant applicable provisions of national and European legislation. In addition, Truberries™ has already incorporated into this Policy the provisions of European law and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the Protection of Individuals with regard to the Processing of Personal Data and on the free movement of such data and the repeal of Directive 95/46 / EC (General Data Protection Regulation, internationally known as GDPR).

For the maintenance of this Record, Truberries™ has made a Notification to the Personal Data Protection Authority and respects all legitimate measures for the security and protection of such data. User Data kept in the Truberries™ Record is the same as entered by the User, after granting his/her consent when registering in Truberries™ services, applications, platforms or market research as described below.
In particular, when registering, users (natural persons) register or may enter the following data: Gender, Email, Username, Password, Photo.
In addition, the following data is or may be recorded:
Name, E-mail, Date of Birth, Cell Phone Number, Additional Mobile Phone Number, Home Phone Number, ID Card Number, Address, Postcode, Area, Sex, Educational Level, Occupation, children, number of people in the household, Smartphone personal use, Internet personal use, personal photos, videos, product or service preferences.
The purpose of collecting these Data is to conduct scientific research, in particular market research, and the related use of the website, application or platform in any market research conducted by Truberries™. Personal data is not available (visible) to third-party users because they appear with a code instead of their full name. By way of exception, Truberries™ employees may be restricted to access to User personal data exclusively for the purposes of organizing and operating market research, which are bound by equivalent conditions of protection of such data. For storage purposes only, the data is transmitted to the server hosting the market research. User consent in the Truberries™ Privacy Policy simultaneously provides the User's express consent to the processing and forwarding of the User's Personal Data to third parties solely for the execution and analysis of market research carried out by Truberries™, including Truberries™ customers.
User's personal data may be used for advertising purposes, in particular for advertising additional features, advertising other applications to promote products or services from third parties.
Users (Data Subjects) have the right at any time to disable, revoke their consent, correct, request the deletion, modify, update the Personal Data that they have declared, and even disable their registration at any time, the right of access and transmission of a copy, the right to limit processing, the right of portability and the right not to be subject to a decision taken solely on the basis of automated processing, including profile making, which produces legal effects that affect the user or significantly affects them in a similar way, by sending an email to info@truberries.com. At the same address, stating as "My Data" the topic title, users may address any information or objection regarding the processing of the Personal Data they have filed in accordance with the law.
It is explicitly stated to the users that it is absolutely forbidden any publication of third party personal data by the users if they do not have the right to do so. If Truberries™ receives any complaint or notice that a user is providing Truberries™ with information that violates any third party's personal data, Truberries™ may immediately delete this user's account without prior notice and exclude him/her from future market research.
We inform each user that their personal data will be retained before they are completely destroyed for five (5) years from the time that the user will delete his/her Truberries™ account or be deleted from Truberries™ due to violation of these terms of use, including Privacy Policy, or revocation of his or her consent to the processing of his or her personal data. We expressly declare that we do not guarantee the proper functioning of this website, application, platform or market research. Also to the fullest extent permitted by applicable law, we disclaim any warranty, whether direct or indirect, including any warranty on the proper functioning of the site, application, platform or market research or the absence of errors. Also, to the fullest extent permitted by applicable law, we do not provide any warranty and we can not be held responsible for the successful or secure transmission of the information transmitted in connection with this application, platform, or market research.
Other Provisions
We do not warrant continued access to this site, application, platform or market research since, among other factors, it may not be available due to force majeure, external factors or other issues. We may transfer or assign to third parties the exercise of our rights under this Agreement without prior notice to you. We retain the right to amend this agreement at any time. If you continue to use this app, platform, or participate in a market research after we have informed you about any changes in the Terms of Use and Conditions, that means you agree to the changes. In the event that a provision of this Agreement is or becomes unlawful, void or unenforceable in any jurisdiction, it will not affect the validity or enforceability in this jurisdiction of any other provision of this Agreement or the validity or enforceability in other jurisdictions of that or any other provision of this Agreement. All disputes relating to this Agreement or the use of the Application are subject to the exclusive jurisdiction of the Greek courts. Also, the agreement and any use of this application are governed by Greek law.
